Relevant Legal Basis

The processing of personal data, such as the name, address, email address, or telephone number of a data subject, is carried out by us exclusively in accordance with the requirements of the General Data Protection Regulation (GDPR) and in compliance with the country-specific data protection provisions applicable to us in Germany.

According to the requirements of Art. 13 GDPR, we inform you about the legal basis of our data processing: The legal basis for obtaining consent is Art. 6 Para. 1 lit. a and Art. 7 GDPR, the legal basis for processing to fulfill our contractual obligations and to respond to inquiries is Art. 6 Para. 1 lit. b GDPR, the legal basis for processing to fulfill our legal obligations is Art. 6 Para. 1 lit. c GDPR, and the legal basis for processing to protect our legitimate interests is Art. 6 Para. 1 lit. f GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 Para. 1 lit. d GDPR serves as the legal basis.

Deletion and Blocking of Data

We adhere to the principles of data avoidance and data economy. The personal data processed by us will be deleted or restricted in their processing according to the provisions of Art. 17 and 18 GDPR. Unless explicitly stated in this privacy policy, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and the deletion does not conflict with any statutory retention obligations. If the data is not deleted because it is required for other and legally permissible purposes, their processing will be restricted. This means the data are blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons. According to legal requirements in Germany, storage is carried out in particular for 6 years according to § 257 Para. 1 HGB (German Commercial Code) and for 10 years according to § 147 Para. 1 AO (German Fiscal Code).

Transfer of Personal Data

We only forward your personal data to third parties within the framework of the purpose of processing. Our employees and suppliers/partners are obligated by us to confidentiality and secrecy and by law to data secrecy.

SSL or TLS Encryption

For security reasons and to protect the transmission of confidential content, our site uses SSL or TLS encryption. 2. Data Collection, Types of Processed Data, Categories of Data Subjects, Processing Purposes

Hosting

We use hosting services to provide the following services: infrastructure and platform services, computing capacity, storage space, and database services, security services, and technical maintenance services that we use for the operation of this website. In this context, we, or our hosting provider, process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, prospects, and visitors of this online offer in order to pursue our legitimate interests in an efficient and secure provision of this offer according to Art. 6 Para. 1 lit. f and Art. 28 GDPR.

Collection of Access Data

Each time our website is accessed by a data subject or an automated system, our website collects a series of general data and information for the purpose of pursuing our legitimate interests according to Art. 6 Para. 1 lit. f GDPR. This general data and information are stored in the server's log files. Collected are (1) the types and versions of browsers used, (2) the operating system used by the accessing system, (3) the referrer URL, (4) the sub-websites accessed via an accessing system on our website, (5) the date and time of access to the website, (6) the IP address, (7) the Internet service provider of the accessing system, (8) logs, status code, and data volume; (9) the directory protection user and (10) other similar data and information that serve to prevent dangers in the event of attacks on our IT systems.

IP addresses are stored anonymously. For this, the last three digits are removed. IPv6 addresses are also anonymized. Information on the directory protection user is anonymized after one day. Error logs, which log faulty page accesses, are deleted after seven days. In addition to the error messages, they contain the accessing IP address and, depending on the error, the accessed website. Accesses via FTP are logged anonymously and kept for 60 days. The mail logs for sending emails from the web environment are anonymized after one day and then kept for 60 days. In the process of anonymization, all data concerning the sender/recipient, etc. are removed. Only the data concerning the time of dispatch and information on how the email was processed remain (queue ID or not sent). Mail logs for sending via our mail servers are deleted after four weeks. The longer retention period is necessary for the functionality of the mail services and spam fighting. An individual determination of the storage duration is not possible.

Data required for further retention for evidential purposes are excluded from deletion until the incident is resolved.

In the use of this general data and information, no conclusions are drawn about the data subject. This information is needed to (1) deliver the contents of our website correctly, (2) optimize the content of our website and the advertising for it, (3) ensure the long-term functionality of our IT systems and the technology of our website, (4) to enable the response to contact inquiries and communication with users, and (5) to provide law enforcement authorities with the information necessary for criminal prosecution in the event of an attack. These anonymously collected data and information are therefore evaluated statistically by us with the aim of increasing data protection and data security, in order to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

Data Processing for Performance Fulfillment

We also process the data of our customers in the context of our contractual services, which include conceptual and strategic consulting, lectures, seminars, etc.

In this context, we process inventory data, contact data, content data, contract data, payment data, usage and meta data. We generally do not process special categories of personal data. The circle of data subjects includes customers, prospects, and their customers, users, website visitors, employees, and third parties. The purpose of processing is the provision of contractual services, billing, and customer service based on Art. 6 Para. 1 lit. b GDPR. We process data necessary for the establishment and fulfillment of contractual services and disclose the data only if necessary in the context of contract fulfillment. In processing the data provided to us in this context, we act according to the instructions of the client and the legal requirements of order processing according to Art. 28 GDPR. The data are processed for no other purposes than those specified in the contract. The data are deleted after the expiration of legal warranty or comparable obligations, whereby the necessity of the retention is reviewed every 3 years. If legal retention obligations exist, the data are accordingly blocked.

Data Processing in the Context of Company Organization

In the context of the organization of operations, internal administrative tasks, financial accounting, and the fulfillment of legal obligations, we generally process the same data that we also process in the context of providing our contractual services according to Art. 6 Para. 1 lit. c and f GDPR. Affected are customers, prospects, business partners, and website visitors. The purpose of the processing is administration, financial accounting, organization, archiving, maintenance of business activities, fulfillment of our tasks, and provision of the contractually owed services. In this process, we disclose data to the financial administration, tax advisors, auditors, fee offices, and payment service providers. In addition, based on our business economic interests, we store information on suppliers, event organizers, and other business partners. These company-related data are generally stored permanently.

We analyze the data available to us on business processes, contracts, inquiries, etc. to operate our company economically and to be able to recognize market trends and customer preferences. In this process, we process inventory data, communication data, contract data, payment data, usage data, meta data based on Art. 6 Para. 1 lit. f GDPR. Affected persons are customers, prospects, business partners, visitors, and users of the online offer. The analyses are not disclosed externally, unless they are anonymous analyses with summarized values.

Contact

When contacting us (via contact form, email, telephone, or social media), the user's information is processed for handling the contact request and its processing according to Art. 6 Para.1 lit. b GDPR. The user's data can be stored in a CRM system or a comparable request organization. The entered data are not disclosed without the consent of the data subject.
We delete the inquiries and data immediately if we are requested to do so, or if the data subject revokes consent to storage or if the purpose for the storage no longer applies, i.e., if they are no longer necessary. We review the necessity of retention every 2 years. Otherwise, the general legal retention obligations apply.

Cooperation with Processors and Third Parties

If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit them to them or otherwise grant them access to the data, this is done only on the basis of legal permission (e.g., if a transfer of data to third parties, such as to payment service providers, is necessary for contract fulfillment according to Art. 6 Para. 1 lit. b GDPR), if you have consented, if a legal obligation provides for this, or on the basis of our legitimate interests (e.g., when using agents, web hosts, etc.).

• The personal data were collected or otherwise processed for purposes for which they are no longer necessary.

• The data subject withdraws their consent on which the processing is based according to Art. 6 Para. 1 lit. a GDPR or Art. 9 Para. 2 lit. a GDPR, and there is no other legal basis for the processing.

• The data subject objects to the processing according to Art. 21 Para. 1 GDPR, and there are no overriding legitimate grounds for processing, or the data subject objects to the processing according to Art. 21 Para. 2 GDPR.

• The personal data were processed unlawfully.

• The deletion of personal data is necessary to fulfill a legal obligation under Union or Member State law to which the controller is subject.

• The personal data were collected in relation to the offer of information society services referred to in Art. 8 Para. 1 GDPR. If one of the above reasons applies and you wish to request the deletion of personal data stored by us, please contact our data protection officer.

Right to Restriction of Processing

Furthermore, you have the right to request the restriction of processing from us if one of the following conditions is met:
